Terms & Conditions Policy - Refund and Privacy Policy

Use Case for Recurring Payment

Lulou Wellness offers a monthly subscription service designed specifically for seniors. The recurring payment feature allows members to enjoy uninterrupted access to our facilities and services, including stretching sessions and social areas.

  • Billing Cycle: Monthly, Quarterly, Semi-annual, annual

  • Payment Method: Credit card via Xendit

  • Customer Consent Process: Members provide explicit consent during the registration process by agreeing to the terms and conditions and authorizing automatic monthly deductions.

  • Cancellation Policy: Members can cancel their subscription at any time before the next billing cycle to avoid further charges.

Terms and Conditions Policy for Members

  1. QR Access Code. The fee paid for the QR access to the gym is non-refundable and non-transferable under any circumstances. You must present your QR Access Code upon entering the Gym and that it only admits you. 

  2. Misuse of QR Code. You must not allow anyone else to use your QR Access Code and must alert the Gym immediately if it is lost or stolen. If this policy is violated, you may be charged a guest fee and/ or have your membership suspended or cancelled subject to a cancellation fee. There will be a replacement fee equivalent to the cost of a new QR Access Code. 

  3. Guest fee. You can bring first-time guests only by setting an appointment with the gym staff and you must not bring in        guests or other members at any time, including non-staffed hours. You may be charged a guest fee and/or have your membership suspended or cancelled subject to a cancellation fee and/ or charged all dues if this policy is violated. Guest terms and conditions apply. 

  4. Auto debit. You agree that the direct debit/credit card auto pay of your membership dues will happen every month/quarter/semi-annual/annual, depending on the plan you have chosen and your joining date, and are payable until the Minimum Term Expiry Date and during any Continuing Membership Period even if you do not use the Gym.   

  5. Late payment fee/Collection fee. It is your sole responsibility to ensure sufficient funds are in the nominated account or      your credit card is valid with sufficient credit limit and validity date when the monthly payments are due and if a             debit/charge are unsuccessful you will be responsible for any administration fees and/or collection fees. It is your sole  responsibility to ensure the monthly payments are charged to your account or credit card. The Gym abstains itself from any responsibility in terms of communication to Members of failed payments. All charges and eventual fees are non-disputable. 

  6. Collection Service Provider. You irrevocably agree and understand that the failure to meet the requirements in POINT 4 will incur in all your personal information available to Outliers Technohub Corporation being passed on to debt collection service providers, law firms, financiers, government authorities or other organizations. Please note LEGAL ACTION WILL BE TAKEN against non-paying members. You agree the Gym shall be entitled to recover all costs and expenses resulting from the engagement. 

  7. Cancellation Procedure. You are not entitled to cancel your membership during the Minimum Term except in the circumstances set out in the Membership Agreement. Should you decide to cancel after your minimum term, a month calendar written notice will be required subject to the approval of the Management. The Management may require you to pay cancellation fees worth Php7,000.00 .

  8. Freeze Procedure. Should you be unable to use the facilities due to travels abroad or medical reasons, you must present documentation in writing one month in advance to allow you to freeze your membership at no cost. You can suspend your membership for a minimum of one (1) month to a maximum of three (3) months after which your membership will automatically resume to being active and you will be billed your regular monthly dues. 

  9. Gym ethics. You shall not engage in any type of commercial or business activity while using the facilities. You shall not act as a trainer for any other members or guest and any acts which constitute such business activities, your membership shall be subject to immediate cancellation and the balance of this Agreement shall become due and demandable in full and must be paid immediately.

  10. Emergency Procedures. You are responsible for understanding how to operate the panic alarms and agree to use them only in case of emergency. Misuse of any of the alarm and/or safety equipment will lead to heavy fines. 

  11. Declaration of Personal Information. You hereby confirm your particulars; telephone and email addresses were provided and verified at the time of signing this agreement, terms and conditions. Only the terms and conditions printed on the membership agreement, Personal Training agreement and Gym Rules will apply. 

 

Refund and Privacy Policy

Refund Policy:

  • Refunds are only applicable in cases of double billing or erroneous charges.

  • Refund requests must be submitted within 7 days of the transaction.

  • Approved refunds will be processed within 14 business days.

Privacy Policy:

  • Data Collection: We collect personal information such as name, contact details, and payment information for membership management and billing purposes.

  • Data Usage: Information is used exclusively for billing, customer support, and service improvement.

  • Data Protection: Lulou Wellness implements industry-standard security measures to protect personal data.

  • Third-Party Sharing: We do not share customer information with third parties, except for payment processing through Xendit.

  • Member Rights: Members can request data access or deletion at any time.
